1. Acceptance of Terms
By accessing and using the ForecourtSync software and website ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this Service. ForecourtSync is a commercial product intended strictly for business-to-business (B2B) use by automotive dealerships and related trades. By subscribing, you confirm you are purchasing the Service for business purposes.
2. Description of Service
ForecourtSync provides an AI-powered image processing tool designed for automotive dealerships. The Service allows users to upload vehicle images, remove backgrounds, and apply virtual branding.
3. Subscription and Billing
The Service is billed on a subscription basis. You will be billed in advance on a recurring, periodic basis (monthly). Payments are processed securely via Stripe. All fees are stated in £ GBP and are exclusive of VAT unless otherwise stated.
You may cancel your subscription at any time via the billing portal. Downgrades or cancellations will take effect at the end of your current billing cycle. No prorated refunds are provided for partial months.
4. Account Security
You are responsible for maintaining the confidentiality of your login credentials. ForecourtSync cannot and will not be liable for any loss or damage arising from your failure to protect your account information.
5. Fair Usage
Accounts are subject to fair usage limits depending on your selected tier. ForecourtSync reserves the right to suspend or terminate accounts that attempt to bypass API limits, upload malicious files, or artificially inflate usage beyond normal dealership operations.
6. Intellectual Property
You retain all rights to the original photos you upload. By uploading images, you grant ForecourtSync a temporary license to process, modify, and store these images solely for the purpose of providing the Service to you.
7. Limitation of Liability
ForecourtSync shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
